BAVKA online store offers to conclude a contract under the terms of this public offer.
By concluding this Agreement, the Buyer fully accepts the terms and procedure for placing orders, paying for goods, delivering goods, and returning goods.
The Agreement is considered concluded from the moment of clicking the "Confirm Order" button on the order page in the "Cart" section and receiving electronic confirmation of the order from the Seller.
1. DEFINITIONS
Seller — Individual Entrepreneur Khoma Alina Volodymyrivna, selling goods through the bavkatoys.com online store
Buyer — individual or legal entity placing an order in the online store
Goods — products presented in the bavkatoys.com online store catalog
Custom Order — goods manufactured according to individual Buyer specifications
2. SUBJECT OF THE CONTRACT
Sale of goods through the website www.bavkatoys.com. Product descriptions, prices and payment methods are available in the "Catalog" section.
3. ORDER PLACEMENT
3.1 Ways to place an order:
- through the "Cart" form on the website
- by email
- by phone number specified in the "Contacts" section
3.2 Required information when placing an order:
- Buyer's surname and name
- Buyer's phone number
- delivery address
- carrier and branch
3.3 Terms for custom orders:
- manufactured only after 50% or 100% prepayment
- production time — up to 14 business days
- not subject to exchange or return
- Seller has the right to refuse production under certain circumstances
If the Buyer fails to provide necessary information, the Seller is not responsible for providing quality service.
4. PAYMENT
4.1 Payment methods:
- online payment by bank card
- by bank details
- cash on delivery payment at the branch
- installment through MonoBank (if available)
4.2 Payment security:
When paying by bank card, payment processing occurs on a secure page of the processing system. PCI DSS standard, SSL protocols and other security methods are applied.
Card details are not stored or transferred to the Seller.
4.3 Payment confirmation:
The Seller sends the order receipt in electronic format to the Buyer's preferred messenger.
5. DELIVERY
5.1 Delivery cost:
- not included in the product price
- paid by the Buyer according to delivery service tariffs
5.2 Insurance:
The Buyer may specify the desired insurance amount in the order notes. By default, the actual order value is indicated.
5.3 Verification upon receipt:
The Buyer must check in the presence of the delivery service representative:
- product name
- quantity and completeness
- absence of external damage
- expiration date (if applicable)
5.4 Transfer of ownership:
Ownership rights and risk of accidental loss transfer to the Buyer from the moment of transferring goods to the delivery service.
6. EXCHANGE AND RETURN OF GOODS
6.1 General conditions:
Regular goods may be returned within 14 days from receipt, provided:
- preservation of product appearance
- presence of packaging
- preservation of all labels and tags
- product has not been used
6.2 Goods NOT subject to return:
- custom orders
- goods with individual properties
- goods for newborns (for hygienic reasons)
- electronic goods (digital materials, PDF files, videos)
- quickly perishable goods
- goods with damaged packaging (if it affects safety)
6.3 Return procedure:
- Contact the Seller within 14 days
- Receive consent for return
- Send goods at own expense
- Receive refund within 14 days after Seller receives the goods
6.4 Product exchange:
Exchange is possible in case of:
- discovering defects or flaws
- product non-compliance with description
- damage during transportation
7. WARRANTY OBLIGATIONS
- Seller guarantees product compliance with website description
- Warranty period is specified for each product separately
- Warranty does not cover damage due to improper use
8. PARTIES' LIABILITY
8.1 Seller is not liable for:
- damage from improper product use
- untimely fulfillment of obligations in case of providing false information by the Buyer
- delivery delays due to delivery service fault
8.2 Force majeure circumstances:
Parties are released from liability in case of force majeure: war, natural disasters, government actions, etc.
9. PERSONAL DATA PROTECTION
The Buyer consents to collection, processing and transfer of personal data in accordance with the Law of Ukraine "On Personal Data Protection."
Data is used exclusively for:
- fulfilling contract terms
- conducting mutual settlements
- providing documents and support
10. DISPUTE RESOLUTION
- Disputes are resolved through negotiations
- In case of failure to reach agreement — through court according to Ukrainian legislation
- Contract concluded on Ukrainian territory
12. ELECTRONIC GOODS AND COPYRIGHT
12.1 Terms of purchasing electronic goods:
- electronic goods (PDF files, videos, digital materials) are provided to the Buyer for personal use
- not subject to exchange or return after receiving access to files
- electronic materials are provided once to the Buyer's email
12.2 Copyright:
- all electronic materials are protected by copyright
- transfer to third parties is PROHIBITED and constitutes a violation of Article 176 of the Criminal Code of Ukraine
- Buyer undertakes not to distribute, copy or transfer received materials
- use of materials is permitted exclusively for personal needs
12.3 Liability:
- for copyright infringement, the Buyer bears criminal and civil liability
- Seller has the right to demand compensation for damages in case of illegal distribution
